Will my nephew serve prison time for a second degree burglary and fourth degree grand larceny?

Answered by attorney Terry Alan Nelson (Unclaimed Profile)
Criminal Law lawyer at Nelson & Lawless
Every crime carries potential jail or prison upon conviction. The honest answer is that no attorney can predict the outcome, nor even give an intelligent opinion, without reviewing and knowing all the charges, evidence, police reports, expected testimony, priors history, etc. If this is not a California case, as appears from your description of the charges, then repost to attorneys in your state, and either consult with local counsel in your state, or apply to the Public Defender.

What do I do if I am charged with theft even if the owner is not pressing charges?

Hire an attorney to represent you to keep this off your permanent criminal record. The prosecutor has the power to prosecute you for a crime of theft even if the other fraternity is not pressing charges.

If I was arrested with possession and use of drug paraphernalia, I am only 18 years old and I can’t afford an attorney, what are my options?

The first court date will be the arraignment, at which you must plead not guilty and ask for the public defender to be appointed. That will be followed by a series of pre-trials each month or so until the case is resolved.
