How do I go about transferring my misdemeanor probation in one state to another?

default-avatar
Answered by attorney Irwin G. Klein (Unclaimed Profile)
Criminal Law lawyer at Law Offices of Hein, Waters and Klein
Ask your Probation Officer to explain the process of transferring your probation. You will have to get the new state probation department to accept you. Some states are more difficult than others.

If you are charged with first degree burglary and go to trial, does the jury have to find you guilty?

default-avatar
Answered by attorney Jared Christian Winter (Unclaimed Profile)
Criminal Law lawyer at Law Office of Jared C. Winter
A burglary is "breaking and entering" into a building or a residence with the specific intent to commit larceny or any felony inside. In other words, what matters is the person's intent at the time they broke in, not whether or not they actually succeeded in the theft. If the stolen property was actually his property, then that may help in defending the case. But generally speaking, you are not legally entitled to "self-help" when someone has taken your property. In other words, you can't break into other's houses to take things, even if they belong to you. Calling the police is the way to solve that problem.

How long is the process to expunge a misdemeanor case from 21 years ago? And how much would this cost?It was for possession of alcohol under the age

George Lawrence Sandefer
Answered by attorney George Lawrence Sandefer (Unclaimed Profile)
Criminal Law lawyer at Sandefer Law Firm
If you are eligible for a sealing or an expungement the time fram is usually from 6 months to a year to complete it.  This is mainly due to the delay while the Florida Department of Law Enforcement does a record check to issue a certificate of eligibility. They have  a large  backlog.  The application process and the motion and court process does not take a long time. To be eligible you have to have not been convicted on your charge and have no other convictions on any other charges.  No convictions means either it was dismissed or you received what is called a withholding of adjudication.  Depending on the jurisdiction even if you were adjudicated guilty and that is your only offense it may be possible to put you in a position to become elilgible for a sealing.  You would have to consult with a criminal defense attorney in the county where the charge occurred.
