Problem is some creditors refuse to return the funds. So your attorney has to either file a Motion/suit to get the money back or some Trustees will do it for you on a commission basis.

The sale of the home could possibly be a preference if it is sold to pay the debt of another entity prior to your personal bankruptcy.  A preference is a transfer to a creditor within 90 days prior to bankruptcy which allows that creditor to receive more than other creditors would receive.  More information would be need to evaluate this issue. Yes. You can file a Chapter 13 bankruptcy and put the arrears in the repayment plan. This plan can stretch for 5 years which should give you some breathing room. Once your case is filed however you will have to resume making your normal monthly child support commitments.
