The first question is, why did your ex quit claim his part of the house to you? If it was part of the divorce settlement, you're OK. If he just handed it to you with no reason, the trustee in his bankruptcy might be asking for 1/2 the house to be turned over to him/her. Assuming that's not a problem, since you own the house, all of the profit on the sale is yours. There is a $500,000 exemption for the profit on the sale of your primary residence, so you probably won't have to pay any income tax on the sale.

Short sales may also cause you to have a tax liability from "forgiveness of indebtedness" income taxes. The lender agreeing to the short sale may also demand a judgment against you as a condition of agreeing to the short sale. The real estate agent and the lender always come out ahead. The reason is the agent gets a commission. The lender will not accept a short sale if less is received from the short sale than the lender believes it will receive after completing a foreclosure. You need to consult with an attorney to determine what is in your best interest. I expect the real estate agent and the lender who are knowledgeable about this situation to look after their interest. You need an attorney who will look out for your interest.

First, you don't have a choice; all debts are included in a bankruptcy. It's not pick and chose like a restaurant menu. Second, if your house is worth more than the amount of the mortgage, selling would be no problem.
