- not sure based on the lack on information you've presented; what does "pushed the house through the bankruptcy" mean? Did you surrender it on the DEBTORS STATEMENT OF INTENTION? If so, they can't or shouldn't assess a deficiency. However, if the sale occurred BEFORE the date of filing of your petition, then there was nothing that you could do to protect the house any longer. *

You should seek counsel to discuss all options, but the major drawback of a bankruptcy filing is that is remains on your credit report for a long time10 years from filing date for chapter 7 & employers often check credit reports. Please know that student loans are not currently dischargeable in bankruptcy. And you can only file a chapter 7 bankruptcy once every 8 years, so timing is important. If, however, you feel your debt is overwhelming, perhaps you will choose to file. It's a personal decision.

Per the bankruptcy code, a 'petition' must accompany the opening of any case, with a complete list of creditors (matrix), or the case will dismissed automatically by the Court within a day or two of warning. Thereafter, the 'balance of schedules' must follow the petition and creditor matrix within 15 days of the case opening. Given the date shown in this hypothetical situation, the case should have been automatically dismissed by the Court on or about May 14, 2012. It is important the petitioner seek competent counsel in the petitioner jurisdiction to determine qualifications and rights under Title 11 of the United States Code.
