How much does it cost to file for bankruptcy?

Answered by attorney David C. Ayer (Unclaimed Profile)
Bankruptcy lawyer at AyerHoffman, LLP
You should consult with a bankruptcy attorney to determine if bankruptcy is appropriate for you and, if so, which Chapter. There are many factors which go into determining the right Chapter. Look for an attorney who will give you a free consultation. Many of us do. The cost of the bankruptcy will depend largely on which Chapter you file and the complexity of your financial situation. Filing fees with the Bankruptcy Court run in the neighborhood of $300. Attorney fees can range from$500 to $3,500 and beyond.

How do I get garnishment portion over $3000 returned after Chapter 7 was discharged?

Answered by attorney Margaret L. Evans (Unclaimed Profile)
Bankruptcy lawyer at Law Office of Margaret L. Evans, PC
Question: How do I get garnishment portion over $3000 returned after Chapter 7 was discharged? Question Detail: My wages were being garnished so I filed Chapter 7, which immediately stayed the order. However prior to filing $3000.00 was taken. I was told that I should get a portion of that back. What do I need to file? *- not sure who told you that since I've NEVER had any garnishments returned to a client ... if anything, the trustee would receive that payment and use it to distribute to the pool of unsecured creditors, but that would normally only be in an odd or unique situation.

Can I change my attorney before my chapter 13 plan is confirmed?

Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
Your retainer agreement ought to spell out how much communication your attorney is obligated to provide you for the "flat fee" you agreed to pay. If you change attorneys, you still must pay your original attorney for the services provided so far as well as paying your new attorney for the services provided. It is obvious that part of the communication problem is about you feeling that the attorney ought to personally respond to your call on your timeline and that your current attorney doesn't operate his business in that way. Under these circumstances, I would urge you to look for someone that you can communicate with as you desire, but be warned that many attorneys do not handle their communication in the way you seem to desire and expect to pay a pretty penny for legal services if you need constant attention.
