Since they were full aware of the Chapter 7 and did not claim to any assets was this debt automatically included or do we need to reopen?

Bankruptcy lawyer at R. Jason de Groot, P.A.
You will not be allowed to reopen to include the creditor. This is just one reason why it is very important to list all creditors, even family members when filing bankruptcy. As a result of not listing them, the debt was not discharged, and you still owe it. That is the result when you do not list and give notice to the creditor.

Would funeral expenses be part of bankruptcy?

default-avatar
Answered by attorney Jeffrey Pat Heineman (Unclaimed Profile)
Bankruptcy lawyer at Heineman Law Office
The debt will be dischargeable unless the funeral home can demonstrate that she incurred the debt fraudulently. In other words, she incurred the debt knowing that she had no intent on paying it. It is a difficult burden for the funeral home to hurdle, and it is doubtful that it will try. For the record, creditors use the "we will pursue this" card to try to scare people into paying. Don't do it.

I filed a chapter 7 and want to know how much of my State or Federal Tax Return the court or trustee will take?

Bankruptcy lawyer at Reger Rizzo & Darnall, LLP
It depends on whether you have any of your personal exemption left, if so, they may not take any of it.
