Is there a minimum dollar amount you have to have to file medical bankruptcy?

Answered by attorney Dorothy G. Bunce (Unclaimed Profile)

Bankruptcy law doesn't set out any minimum amount you must owe, but you should be sensible. After all, bankruptcy is your lifeline and you only get one shot at obtaining a discharge every 8 years. It would be foolish to blow away your right to receive a discharge for a small amount of debt, and other options are available.

Is there a way to file bankruptcy and get out of my student loan as well?

Answered by attorney Edward M Olson (Unclaimed Profile)
Bankruptcy lawyer at Olson Law Firm
Sounds like it is time for your parents to step up to the plate and provide you some health insurance. The child support and student loan are non-dischargeable. If the credit card obligations are part of the divorce settlement (and considered spousal support), they may also be non-dischargeable. You should call an attorney to obtain legal advice regarding your specific situation.

Can I sue him for misrepresentation?

Since the debt has been discharged as to you, the bank has to go after him. If he files bankruptcy it can be discharged as to him as well.
