I filed and received a discharge for a chapter 7 in 2009 that included documentary stamps that were outstanding in Florida.

If it was truly discharged that is a violation fo the automatic stay and you can go to BK court to sanction them.  YOu need to be careful though because many types of debt owed to the State of Florida would be Non-Dischargeable priority debt.     YOU WILL NEED TO CONSULT A LAWYER to analyze the obligation and why it is not being considered discharged, as well as if you have the right to pursue sanctions.

If I have a loan with a co-signer and the co-signer files bankruptcy, how does it affect my loan and me?

Answered by attorney Michael O'Leary
Bankruptcy lawyer at Hayward, Parker O'Leary
Assuming that the co-signer's name is not on the bike's Certificate of Title, the co-signer's bankruptcy attorney cannot "take" the bike from you. However, the attorney probably just needs the creditor's name, address, account number and amount due so that he can properly prepare the co-signer's bankruptcy petition. There is no harm in giving said information to him. On your credit report there probably will be a notation next to the bike loan which essentially states "co-signer filed bankruptcy", or words to that effect. As long as you continue to make the bike loan payments, the co-signer's filing should have no negative impact on you.

Can a creditor still seek debt due to home address change?

Answered by attorney Robert S Payne (Unclaimed Profile)
Bankruptcy lawyer at Robert S. Payne, Attorney at Law
The creditor is arguing that they weren't properly served. They own the home, so their argument is very, very weak. If the creditor is now attempting to collect on a debt discharged in your bankruptcy, call your lawyer. He/she will send out a letter advising the creditor that they are violating bankruptcy law.
