Will the new trustee take into account my new job?

David Michael Benson
Answered by attorney David Michael Benson (Unclaimed Profile)
Bankruptcy lawyer at Benson Law Firm
In many jurisdictions, you must report to the Trustee when your income increases more than 10% from the amount listed on Schedule I. In our office, we ask clients to report any increase (or decrease) in income to us so that we can decide whether the Trustee needs to be notified. I would suggest you discuss this matter with your attorney ASAP.

I filed in 2005 a Chapter 13, finished it in 2010 can I file a Chapter 7 now?

Generally, you can file a Chapter 7 after a 13 either 6 or 8 years from the date the 13 was filed. The difference depends on the amount you paid your unsecured creditors through your prior 13. You should discuss this in person with a knowledge bankruptcy attorney.

Will we be able to keep our vehicle in a chapter 13 bankruptcy?

Answered by attorney David C. Ayer (Unclaimed Profile)
Bankruptcy lawyer at AyerHoffman, LLP
The assets you are allowed to keep and those which must be liquidated are determined on a case-by-case basis. Chapter 13 bankruptcies are complicated. You should consult with a bankruptcy attorney to explore which exemptions will apply in your case, allowing you to keep property in which you have equity. You may be able to reaffirm the loan on the trailer and keep making the payments. Your equity in it will be a major factor in this determination.
