Is there a way for me to keep the car and continue payments?

Answered by attorney Robert Jason De Groot (Unclaimed Profile)
Bankruptcy lawyer at R. Jason de Groot, P.A.
This is an account receivable in their bankruptcy, and it should not matter that you are making payments, as it is income to the bankruptcy estate. But we do not know how much you owe, and it may not be practical for them to continue to accept payments. Consult with an attorney as opposed to trying to get answers on the internet. It might help them for you to continue to make payments too. We only have a few facts you have given, and those are not enough to get a complete answer. Attorneys deal with facts and the law. You need meat to make meatloaf, we need facts to give advice.

Will I be notified if bankruptcy is approved for another person?

Court ordered restitution is not discharged in bankruptcy. You do not have to file a claim in respect to restitution for it to survive bankruptcy, but you should file a claim nevertheless if there is a chance you can get paid from bankruptcy assets.

How much debt is required to file bankruptcy?

default-avatar
Answered by attorney Dorothy G. Bunce (Unclaimed Profile)
Bankruptcy lawyer at A Fresh Start
Although bankruptcy laws do not state how much or how little debt you must have, filing bankruptcy for less than $10K is, in my opinion, not a smart idea. You don't have to file bankruptcy to not pay your debts, and it could be very difficult to get you to pass the criteria for being eligible to file, which is "are you able to pay 25% of this debt off in 5 years?" That amounts to a payment of less than $42/month based on the numbers you provided. In addition, you are only eligible to obtain a bankruptcy discharge once every 8 years. What if you have a medical emergency a few months after you discharged this small amount of debt, leaving you in worse shape than you were in before?
