The Trustee may also require that you submit the last two years of tax returns so they can verify your income and see if there have been any major changes. Finally, the bankruptcy court, if they have reason to question your tax filings, could ask to see them as well. There are exemptions which prevent some assets from being used to satisfy your creditors. Your bankruptcy attorney can explain them to you. One option might be to wait to actually file the petition until after you have moved and used the money for that purpose. Rent and moving expenses, particularly where you are forced to move by the sale, are legitimate expenditures.

The sale of the home could possibly be a preference if it is sold to pay the debt of another entity prior to your personal bankruptcy.  A preference is a transfer to a creditor within 90 days prior to bankruptcy which allows that creditor to receive more than other creditors would receive.  More information would be need to evaluate this issue.
