You can make an offer to the trustee. I would not do anything until the trustee contacts you or your siblings regarding a settlement offer.

If I file chapter 7 bankruptcy in December, do I lose all my taxes?

Unless the law provides you with an available exemption to protect your tax refund check for next year, it is possible that you would lose most of your tax refund - all of it only if you filed on December 31 or thereafter. So what exemptions might protect your refund? In Nevada, EIC is exempt, as it up to $1,000 on the wildcard exemption, unless used to protect some other asset.

I completely understand the stress that both of you are feeling. I will be happy to answer all your questions. Our office is committed to education as a foundation for anyone who is considering bankruptcy. To that end we ask all our potential clients to watch the free interactive video (step one) listed on the web site link below. The interactive video will explain some basic issues related to the bankruptcy process. Once you (and your spouse, if any) have completed the video, then download and fill out the questionnaire (step two). When we receive the fully completed questionnaire the you (and your spouse, if any) and I will have a free telephonic discussion about your situation.
