Can I amend my Chapter 7 Bankruptcy to include a car I bought after I filed?

You only include debts incurred before filing on a bankruptcy, chapter 7 or 13 not later. If your debt was after filing and the bankruptcy was completed then you are out of luck, you may have to file a chapter 13.

Question: How would I know if I needed to file for chapter 7? Question Detail: I have around $85,000 debt in medical bills and credit cards. I get a structured settlement. *- from what? that will make a BIG DIFFERENCE in whether or not its a protected asset or not ........* I don't want to lose the home. I pay. Everything is in my daughter's name. I couldn't get loan so I pay house payment, taxes, and insurances.* - would have to review what's in her name, how long, etc.; this is too general without enough information to answer accurately*

What is the best thing to do if I have a second mortgage and my home isn't at the value I purchased it at?

Craig Alan Burnett
Answered by attorney Craig Alan Burnett (Unclaimed Profile)
Bankruptcy lawyer at Law Offices of Craig Burnett
It is possible to "strip" your second mortgage by filing Chapter 13. To do so, the property must be worth less than the amount you currently owe on your first mortgage. It is not relevant whether the value of the property is less than the amount you purchased it for. The issue is whether the value is less than the current balance on your first mortgage.
