Can I sell my house after bankruptcy?

Answered by attorney Mark J Markus
Bankruptcy lawyer at Law Office of Mark J. Markus
If your case was closed, you can sell your house at any time.  It has nothing to do with whether or not the debt was reaffirmed.   The reinvestment within 6 months is a requirement of California law and has nothing to do with bankruptcy.  If you do not reinvest the proceeds into a new homestead within 6 months, then you will not have protection of those proceeds from new creditors (or any creditors not discharged in your bankruptcy case).

Can my wife file Chapter 13 bankruptcy to stop the foreclosure sale of our home if her name is not on the mortgage loan or deed?

Question: Can my wife file Chapter 13 bankruptcy to stop the foreclosure sale of our home if her name is not on the mortgage loan or deed? *- NO, if she has no legal interest in the property (other than equitable or marital by way of marriage only) ....... that will NOT work ........ only one of the title holders (you) can do that to stop it for the time being; you will have to file a confirmable plan, however, that pays the arrearage through the plan and stay current on the remaining mortgage payments.
