How do I get a lien holder to release the title on my vehicle if it is totaled?

Peter Maurice Lively
Answered by attorney Peter Maurice Lively (Unclaimed Profile)
Bankruptcy lawyer at The Law Offices of Peter M. Lively
You apparently took out a title loan and subsequently indicated your intent to surrender the vehicle to the lien holder in your bankruptcy petition. The bankruptcy discharge resulted in you no longer owing the debt to the lien holder, but the lien against the vehicle survived the bankruptcy. Even if the vehicle is damaged, you still have a responsibility to physically surrender it to the lien holder - call and advise the lien holder where the vehicle can be picked up or deliver it to the location indicated by the lien holder. If the lien holder doesn't want the damaged vehicle, it may decide to voluntarily release the lien.

Will I have bankruptcy exemptions on workers comp settlement?

In Washington, a worker's comp award is exempt until paid. Consequently, if you file before the award, it is exempt. If after, it is not.
