Representative Matters: Construction
Research Hospital: Represented architect in litigation involving UCLA's new research, teaching,
psychiatric hospitals. Successfully resolved more than $100 million in technical E&O claims arising from the design
construction of this billion-dollar facility. Work included the analysis of multiple contractor
subcontractor claims,
the coordination of a series of structured negotiations focused on sets of related claims.
Regional Hospital: Ongoing construction defect matter at a regional hospital. Investigation determined that improper data input skewed key benchmarks within the project, leading to misaligned segments, deflected steel,
concrete over-pours throughout the hospital construction. Advised insurer on liability based on applicability of the policy
timing of various events throughout the hospital construction.
Restaurants: Represented a major restaurant chain in a series of Americans with Disabilities Act (ADA) lawsuits covering hundreds of franchises throughout California. Advisement included architectural regulatory compliance
eDiscovery management.
Building Supply: Represented a multinational building supply manufacturer in class-action litigation
construction defect lawsuits involving products liability claims.
International School: Commercial construction
fitting out of mid-rise international school in San Francisco. Multi-subcontractor construction, including excavation, demolition, asbestos removal,
on-site shop drawing
blueprint analysis.
Government
Car-Sharing Tech: Successfully advised car sharing transportation network company (TNC) in the negotiation of access to international airport property. Successfully represented company
resolved a series of lawsuits over conditional use permitting, licensing, taxes,
fees sought by local municipalities. Defended company
employees in criminal case involving local ordinance violations. Based on our effective representation, the trial court dismissed all criminal charges outright
settled the civil litigation in our client's favor.
Airport Crash Trucks: Represented a manufacturer of highly specialized aircraft rescue firefighting trucks (ARFFs) in a government contract dispute
defended client against default termination by San Francisco International Airport (SFO). Uncovered improper procurement procedures through use of discovery practice, FOIA, CA PRA,
Sunshine Ordinances. Matter settled when the airport agreed to convert to a termination for convenience under which client recovered the balance of the contract price
other significant consideration, including keeping millions of dollars' worth of fire trucks.
Airport Crash Trucks: Represented a manufacturer of highly specialized aircraft rescue firefighting trucks (ARFFs) in a government contract dispute. Successfully defended client in a jury trial against default termination by Los Angeles World Airports. Jury found no damages against client,
instead client was able to retain progress payments
recover nearly the entire value of the contract, including keeping millions of dollars' worth of completed fire trucks.
Medical Data Processing: Successfully represented a major medical cost containment
disability services provider in a bid protest. Client submitted a proposal to the City of San Francisco pursuant to a Request For Proposals (RFP) for workers' compensation management services. City rejected the proposal based on a determination of non-responsiveness. Submitted a protest on client's behalf based on the fact that the client was the industry leader
clearly met the requirements of the RFP, including prior contracts managing hundreds of thous
s of individual medical records. The City promptly reversed its non-responsiveness determination based on the protest.
Pharmaceutical: Revance Theraputics entered into a license agreement with Medicis Pharmaceuticals for worldwide aesthetic
dermatological rights to a topical botox, at the time in pre-clinical studies. Prepared filing materials for the client in preparation for a Food & Drug Administration (FDA) Phase I-III Review, including quality control.
Intellectual Property
Pharmaceutical: Litigation preparation for one of the highest revenue generating companies in the United States - over $100 billion annual revenue. Matter involved breach of contract litigation for a pharmaceutical product, including theft of trade secrets, trademark infringement,
a patent dispute.
Semiconductors: Litigation preparation for a contract dispute over a licensing agreement regarding the manufacture of semiconductor wafers
micro-processors by SPIL. Allegations included theft of trade secrets by defendant foreign nationals, trademark violations, unjust enrichment,
patent infringement.
Smartphones: Litigation preparation for the patent wars between Apple
Samsung over iPhones
cellular data processing technology. Case preparation included claims of patent infringement, false designation of origin, unfair competition, trademark infringement,
unjust enrichment. Allegations included patent infringement based on iPhone hardware, such as the claim that Apple patented a cellular device with rounded corners
that Samsung's Android phones interface copied Apple functionality, such as the scrolling bounce feature. Counter-claims included allegations of FRAND licensing violations
patent infringement for mobile-communications technologies, such as data processing
data routing.
Park Concession: Advised a major National Park's principal concessionaire regarding an intellectual property dispute instigated by the prior concessionaire, including providing strategic options to cost effectively defend against potential legal action.

Acquisitions
Biopharmaceuticals: Investigated
prepared filing materials for a Federal Trade Commission 2nd Request regarding a merger
acquisition between two pharmaceutical companies. The drugs produced by these two companies serviced the oncology market, specifically the treatment of non-hodgekins peripheral T-cell lymphoma (PTCL). Conducted an anti-trust analysis for the purpose of the merger.
Merger
Acquisition: Investigated
prepared filing materials for a Department of Justice 2nd Request regarding a merger
acquisition between divisions of two Fortune 500 companies. Due to overlap in the merch
ise produced by these two companies, we conducted an anti-trust analysis for the purpose of the merger.
Criminal
Madera County Deputy DA II: Prosecuted felony cases from initial investigation through jury trials, including case investigation, filing complaints, preliminary hearings, settlement conferences, motion practice, jury trials,
appeals. Matters included assault
battery, robbery, burglary, gr
theft auto, DUI's, extradition, child abuse, embezzlement, confidential informant contracts,
capital homicide. Held position of County Narcotics Prosecutor - assigned to Madera Narcotics Enforcement Team (MADNET), worked directly with DOJ, DEA, ICE,
local law enforcement. Jury trials ranged prosecution of drug DUI's to multi-million dollar
international drug trafficking organizations.
Tuolumne County Deputy DA I: Prosecuted variety of criminal matters including assault
battery, theft, DUI's, narcotics, trespass, fish
game violations,
traffic cases. Prosecuted domestic violence cases under a two-year grant through the Violence Against Women Act (VAWA). Cases included stalking, restraining orders, assault,
battery. Managed cases from initial investigation through jury trials, including case investigation, filing complaints, discovery, motions, pre-trial hearings, settlement conferences, jury trials,
appeals.
Pro Bono
Libelous News: Client was booked for prostitution,
a local newspaper published her arrest online. Client was never convicted in part due to a lack of evidence
in part because she completed a pre-trial educational program as part of a plea agreement. Pursuant to the agreement, the case was dismissed
her arrest was expunged as though it had legally never occurred. The local news article online became a barrier for her to find a job,
company refused to take down the libelous article. Representation included successfully persuading the company to completely remove the article within a matter of days. Client was subsequently able to find full time employment.
Barrier Removal: Helped an individual who had convictions for commercial burglary
drugs clean up his criminal record for the purpose of improving his employment options. After cleaning up his record, he was able to go from unpaid volunteer positions while collecting state aid
welfare to accepting full time employment.
Non-Profits: Asian Neighborhood Design (AND) is an architecture
professional design services program designed to help low-income
non-profit organizations with their architectural
permit processing needs. AND' partner organization, Employment Training Center (ETC), is a vocational training program that assists low-income
high risk individuals who have major barriers to employment. Assisted with fundraising efforts
advised on removing barriers to employment for program clients, such as prior convictions.
