You likely cannot sue the person you have been in a relationship for "pain and suffering" for "infidelity." I do not believe Nebraska recognizes a claim for "infidelity" in any circumstance, even if you were married. Although you likely do not have a claim for his "infidelity" by itself, depending on other facts not set forth in your Question, it is possible you might have another claim, such as "intentional infliction of emotional distress." While it may be difficult to establish this type of claim, it may be possible.
