Since the driver was liable for the collision, his own liability policy won't cover his injuries; however, provided the insurance policy is properly in effect on the date of the collision, it should cover your injuries. You would also be covered by the car's PIP coverage for your medical bills in the interim if it was carried on the policy.

You don't mention if the deformation took place at work or not. If Work, then the possibility of a Worker's compensation action could take place. In general, you cant sue a doctor for ignoring you. They must have done something to have caused an injury. It is difficult to tell what if anything the doctor did to make the hand worse. You should consult a hand specialist, not a general orthopedic surgeon.
