Not enough information here. Are you dealing with some type condemnation perhaps. Don't guess at what a court will do. See a lawyer and take him all your papers and then ask your questions. That is what lawyers are for. You folks who try to do things yourself are the ones who get in trouble and make work for all lawyers. You would be better off asking proper advice to start with instead of digging out of a hole later.
