What should I do if I receive an injury in a hit and run accident? How?

Mark Joseph Leonardo

Well if you have not hired an attorney, you should certainly do so. You can also stay in touch with the DA to ensure that as part of any deal he makes with the defendant, the defendant is required to pay you restitution which means the damages you suffered, usually only out of pocket car damages, medical expenses, etc. An attorney knows how to deal with the insurance adjuster to get you the most money possible and would have had your car damages paid for by now.

How do settlements in personal injury cases work?

Answered by attorney Andrew Tyler Velonis (Unclaimed Profile)
Personal Injury lawyer at Andrew T. Velonis, P.C.
There are several questions here: If it is an "on the job accident", the injured person cannot bring an action against his employer, other than worker's compensation. In a worker's comp case, it does not matter who is "at fault". If the claim is against someone other than the employer, then the liability may be apportioned, and the award is divided according to that apportionment. As for settlement, each party is trading a known result against an unknown result so if you are being offered $100, what's the probability of going to trial, winning and getting $1000? or $99? or zero?

Can an insurance company in a pain and suffering release of all claims make you sign that your injuries is for life?

David F. Stoddard
Answered by attorney David F. Stoddard (Unclaimed Profile)

The cannot make you sign anything. However, if you want to settle your case, you will need to sign a release agreeing that this is a final settlement, and agreeing that you cannot come back later an sue for more money, even if the injury turns out to be worse than you thought. Thus, you are settling your case once and for all and you are agreeing that this is a settlement for your injuries for the rest of your life. Your alternative is to go to trial but any jury award will be for the rest of your life.
