Don't waste your energy being angry at the person who was injured. Their lawyer is doing their job by naming all the potentially responsible parties. If the at fault lawyer decides to say that you hit the car in front of you before they hit your car, then the injured party would be screwed. It would be malpractice for the attorney not to name you in the lawsuit. Really more likely than not, the insurance companies (your included) are the ones trying to drag this out and are unreasonable. It is much easier to believe that the other person is lying than the insurance companies are trying to save a few buck and really do not care at all about what nice people like you think and want. You don't have much to worry about.

As you probably know, the minimum age in Georgia that you could contract for settlement of your bodily injury claim is 18. Until you reach that age, your parents are your legal guardians & have the power to settle your case & use the funds (in their discretion) on your behalf. In my view, the only way you could keep the funds is if your claim is not settled until you reach 18. If things are delayed until your 18th birthday, contact the insurance adjuster yourself & request that she deal with you at that point, rather than your parents.

Without detailing how the accident occured, it is hard to really access your son's case.  Was the driver of the other vehicle issued a ticket?  Any police investigation will certainly be helpful in determining fault.  Dealing with an insurance company by yourself is not a fair fight.  They have lawyers, adjusters and a whole team of people who know how to best defend against claims.
