In California you have 2 years from the date of the accident unless a defendant is a public entity, then you have 6 months from the accident to file claim and then 6 months after the claim is denied (they're all denied) to file suit. If you are a minor the clock doesn't start ticking until you turn 18.

If you selected this option when you signed up for insurance (and the circumstances of the accident do not create an exception to the applicability of the threshold) then you have to demonstrate that your daughter suffered a permanent injury. Click here for a link to the jury charge relative to the verbal threshold that describes the injury requirement. Look at charge 533(a) and 533(b). Keep in mind that it is often difficult to determine the nature and extent of an injury. You cannot even attempt to determine things like this until a client is finished getting medical care. If your daughter is getting significant care, you should contact a local personal injury attorney (one in your state). Personal injury attorneys take cases on a contingency basis which means you only have to pay if you succeed. Additionally, initial consultations are free. At the very least, an attorney can open a file and monitor her care, and make sure your insurance company pays all of the medical bills.
