How long do I have to file a work related injury lawsuit?

default-avatar
Answered by attorney Mark T. Peters (Unclaimed Profile)
Personal Injury lawyer at Peters Law, PLLC
If that company was your employer, no. If it wasn't, yes. But the worker's compensation insurance would be entitled to be reimbursed for what it has paid. It may not be worth it to you in the long run.

What can I do if I am being sued in an accident lawsuit but the other driver has no drivers license?

Briny Adam Woods
Answered by attorney Briny Adam Woods (Unclaimed Profile)
Personal Injury lawyer at Woods Williford Personal Injury Attorneys
Unfortunately the law does not care that this guy has no driver's license. It sounds like he is making a claim against you, which you should turn over to your insurance company, if you haven't already. This is why you have insurance.let them worry about it, instead of you.

If your phone is taken away by your teacher, can they search it and go through it or do we have rights as students?

Robert Scott Lawrence
Answered by attorney Robert Scott Lawrence (Unclaimed Profile)
Personal Injury lawyer at Lawrence Bartels LLP
You have rights as students, but those rights are abrogated in certain respects when school safety is at issue or illegality is suspected. Under the U.S. Supreme Court ruling in New Jersey v. T.L.O., 469 U.S. 325 (1985), high school students' persons, papers, belongings and lockers may be searched without a warrant upon "reasonable suspicion" rather than "probable cause," and most universities have the right to spot check dorm rooms without any suspicion of wrongdoing (and you agree to that in the contract with the university). As far as the contents of your phone are concerned, under the Supreme Court's recent ruling in Riley v. California, the contents of your phone may not be searched by the police without a warrant. Post-Riley, several months ago, a district court ruled that school administrators could not search a student's cell phone when they had suspicions that he was carrying drugs (as his phone could not contain drugs). If you are worried about the school searching your texts or emails in violation of your rights, however, then the smart move would to password protect it with at least an 8-figure pass code. Neither the school nor the police can make you to provide your password even with a warrant, as to do so would be a violation of the 5th Amendment. If you fingerprint protect it how, add a pass code, as the police can make you produce your fingerprint.
