If I get another to represent me, do I still have to pay the first one 5% of the estate plus all the fees for the lawsuit?

You may hire/fire your attorney whenever you believe you must due to circumstances. Typically you will have a written agreement/contract or a letter of understanding with your lawyer that spells out the lawyers fees, what they are entitled to if they are fired, etc. If you have such a document, it will control as to how much you must pay the lawyer if you fire them; however, a lawyer may not charge an unreasonable fee and the State Bar and/or the Probate Court would hear any claims that the fee being charged was excessive and/or that it was not earned based on the work that was/wasn't done.

Your family member is looking at some serious charges: DUI: punishable by up to a year in jail and a $5,000.00 fine. Running from the cops: punishable by up to a year in jail and a $5,000.00 fine From you description of the events, he could also be charged with "hit & run" which is also punishable by up to a year in jail and a $5,000.00 fine These are the criminal penalties he faces. As a result of the DUI, ,he will also loose his license, and could also be sued civilly by the person whose car was damaged. My advice to this person is to hire an attorney.
