Depends on what is the cause of action. For example, the time for bringing an action for false arrest/imprisonment starts from the date of arrest/imprisonment while the time to bring a cause of action for malicious prosecution starts from the date that the case is dismissed.  If you are suing under state law there is a one year statute of limitations. If you are suing under Federal Law  there is a three year statute of limitations. If you are suing under state law against a municipality you have to file a notice of claim within 90 days of  false arrest/ imprisonment if making such a claim or if claiming malicious prosecution 90 days from the dismissal of charges.

The wrongful death statute is 3 years, so you can file a civil suit until Aug. 2011. If the only insurance involved already paid out, there's not much point to filing it unless the defendant has substantial personal assets.
