If your niece was not injured, then her damages will be limited to the fair market value of her auto on the date it was totaled out. Check out the FMV on a website such as Blue Book.

What can I do if State farm is refusing to pay my claim?

Answered by attorney Burton A. Padove
Personal Injury lawyer at Padove Law
Clearly, to coin a phrase, they are not treating you like a good neighbor. My suggestion is that you hire counsel to pursue this matter as State Farm is at a great advantage-they litigate claims on a 365 day a year basis, some years 366 days. You need to level the playing field.

What is considered an adult and a minor in an assault or battery case?

Answered by attorney Willie Stephen Graves (Unclaimed Profile)
Personal Injury lawyer at Graves Law Firm
You are considered an adult and your sister is considered a minor. Either way, mouthing off and egging you on is no justification for an assault and battery. Hands off unless you're ready to go to jail. Be satisfied with mouthing off back at her.
