I would fight that. Sounds pretty clear you did nothing wrong. Tell the insurance company they are going to have to explain to their insured (the guy that whacked you) why he's being sued in court and that they are dealing with him in bad faith by not settling a claim they know they should. If the damages support it, sue him in small claims as you won't need to pay an attorney. You can probably submit the police report and some property damage estimates. Then simply explain what happened. Once you get the judgment, the insurance company will pay. This is typically penny pinching by insurance companies and not based on right or wrong. Punish them!
