If the dog threatened or bit anyone before there is strict liability upon the dog owners. Some homeowners policies will pay medical expenses whether the homeowners are legally liable or not. Finally, you should fight your insurance carrier on their disclaimer: they are supposed to cover this, this is what insurance is for.
