What can happen after a pit bull bites my two kids in my back yard that aren't mine?

Answered by attorney Willie Stephen Graves (Unclaimed Profile)
Personal Injury lawyer at Graves Law Firm
If you are on notice that the dog tries to bite through the trampoline and you confine him in a way that lets him get out and bite tramploliners, you have liability exposure. If you receive a claim for the neighbor kids' injuries, notify your homeowner insurance carrier immediately. I know you're an adult, but I have to tell you that keeping a pit bull can be risky business under the best of circumstances.

Is it lawful for a company to fire my husband after an injury?

Gregory Casale
Answered by attorney Gregory Casale (Unclaimed Profile)

In Massachusetts we have what is called "Employee At Will" which essentially means that an employer can fire you for any reason or even no reason as long as it does not fall under one of the statutorily protected reasons, such as being fired for race, religion or sexual orientation. Other than the protected reasons, and there are more, I just gave an example, the only other way your job may be protected in Mass is if you have an employment contract. Then the terms of the contract control. No contract, no protected status, means no recourse. You should probably check with a lawyer who practices in Employment law to make sure since I am a criminal defense and personal injury lawyer, but I think he or she will tell you about what I have told you. However, do not rely on this until you confirm it with an Legal Employment Specialist.

I hurt my back falling off a ladder that had wd-40 oversray on it. I also have a hernia from lifting an ac unit that was over 120lbs. I work overnight

John Joseph Ratkowitz

The legal analysis is that you have a valid workers compensation claim, and you should be getting temporary disability benefits so that you can take off time from work and medical care paid for by the compensation carrier. Additionally, depending on the nature of your injury, you may have a claim for permanency under the workers compensation statute. Finally, if your employer fires you, you will have whistleblower's claim because your employer cannot fire you for asserting your statutory rights. At the same time, these are claims. Workers compensation benefits are less than what you earn, and while you will have a whistleblower's claim against your employer, you will have to pursue that and litigate it over time, so factor that into your decision making process.
