No, this was a judgment call. They felt that the tonsils did not need to be removed at that time. Had it gone the other way, they might have been accused of performing uneccesary surgery.

Yes you can. Your neighbor's contractor broke it, it's up to him to fix it. If he can't figure it out, he should get someone who can. Meanwhile, get a hold of your insurance company. It might be easier for you to put in a claim with them, get the situation rectified, and then let them chase the contractor to get their money back.
