The Doctor would still be able to respond to your request but if he has lost his license the value and even admissibility of the evidence may be compromised. If the Doctor has lost his license and closed his practice I am afraid it is quite doubtful you have any meaningful recourse.

When you are in an accident and someone else is at fault, you generally can sue them within the applicable statute of limitations (2 years in Indiana). Assuming that you prove 100% fault on the other driver, you are entitled to 100% of your damages. In a property damage case where your car is damaged, you are entitled to the cost of repair of the vehicle or the value of the vehicle if the cost of repair exceeds the value (being "totaled"). If your insurance company has already provided you the value of the vehicle, there is nothing else to recover from the other driver.

Most on the job injuries are covered by workers comp, but in a normal injury case, we have modified comparative negligence here in Michigan. Meaning if you are more than 50% at fault, you cannot collect any pain and suffering damages, but still could collect 1% of economic damages in your hypothetical.
