What are my chances of getting my citizenship after this arrest nightmare?

default-avatar
Answered by attorney Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)
Immigration lawyer at Havens Lichtenberg PLLC
It would be a good idea to consult with an immigration attorney before filing a naturalization application. The first problem is that, in naturalization, you have to prove "good moral character" for the last 10 years. An arrest for domestic violence will be a big issue in this regard, even though you were not charged and convicted. The second problem is that domestic violence is an offense for which you can be stripped of your green card status and deported. The court will likely decline to take such a drastic measure because you were not convicted; nevertheless, the Immigration and Customs Enforcement can arrest you and put you in removal proceedings. For these reasons, you might want to consider postponing your naturalization until 2022. If there are reasons why you need to get U.S. citizenship now, you need a legal counsel to get you through the process.

If my husband sponsored his ex wife's green card in 2011, can he sponsor my green card again?

Immigration lawyer at Havens Lichtenberg PLLC
1)Your husband's ex-wife could not file *jointly* for a 10-year green card without his knowledge. 2) Your husband can petition the government for your permanent residence if a) you entered the U.S. legally (if not, the process will be more complicated), and b) both he and you have no legal disqualifications (like certain criminal convictions, past deportation orders, immigration or marriage fraud, etc.); 3) Your husband will have to indicate his ex-wife on the Form I-864 Affidavit of Support as an alien he sponsored in the past; 4) To prepare the documents for your permanent resident status, you do not need any information about the ex-wife's adjustment of status.

Is it possible to obtain a passport if my son was convicted 15 years ago and is a labeled a felon?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
If your son already is a U.S. citizen, he will be able to successfully apply to get a U.S. passport regardless of his felony conviction. If your son is not a U.S. citizen, then a full analysis of his situation would be required in order to assess his eligibility to apply to become a naturalized citizen, and this would include an analysis of his criminal history. Some immigration law firms, including mine, offer legal services on a "flat fee" basis so that a client will know the total expense from the very beginning, and a few immigration law firms, including mine, offer an initial consultation free of charge.
