I do not understand your question. By fixing your papers, do you mean getting a green card? To obtain a green card through marriage you would need to be married to a US Citizen or Lawful Permanent Resident. There is no time frame on the marriage. However, whether you would qualify to adjust status or go through the consular process depends on several factors including the method of entry. If you are asking in regard to naturalization, you can apply after three years of marriage. If you entered the U.S. unlawfully and without inspection, then further details, including the date you entered the U.S., whether anyone has ever filed some sort of immigration-related application for you before, etc. would be needed in order to assess immigration-related eligibilities, options and strategies for you at this time. It would be wise to engage an immigration attorney who, after learning all of the relevant information, could advise you about eligibilities, options and strategies and represent you in the application process. It is not legally required for spouses to jointly file tax returns or to be of similar ages, but you correctly noted that a failure to file joint tax returns, and your and your fiance's age differences, may lead the USCIS to use a heightened level of scrutiny in determining whether you and he are living together in a bona fide marriage. It would be wise for you and your fiance to consult with an immigration attorney who, after learning all of the relevant details, could advise about preparing a persuasive marriage-based application notwithstanding the decision not to file joint tax returns.
