Generally, when a foreign national enters the U.S. lawfully and with inspection, for example with an F1 student visa, and then becomes married to a U.S. citizen, the couple may proceed with a marriage-based Adjustment of Status application in the Immediate Relative visa category. This is true regardless of whether the foreign national spouse may have remained in the U.S. following a school's termination of the I-20. Of course, there are many more details that determine eligibility. It would be wise for you and your fiance to consult with in immigration attorney who, after learning all of the relevant details about you, your immigration-related history and your plans for marriage, would be able to advise about eligibilities, options and strategies and could offer legal representation in the often quite complex application process.

If you are petitioning your husband, your criminal record usually will not affect your ability to file the petition. There are some exceptions, but shoplifting is not one of them. It is the beneficiary's criminal record, if any, that USCIS is most interested in.

It is too bad that you obtained legal advice from a paralegal who, apparently, was illegally participating in the unauthorized practice of law - itself likely to be a crime, depending upon the jurisdiction. You should consult with a domestic relations attorney (sometimes called a "divorce lawyer") about the possibility of filing for an annulment or a divorce. Regarding immigration issues, it is a crime - both for the U.S. citizen and the foreign national to engage in a fraudulent marriage-based petition. If the petition has not yet been adjudicated, it would be wise for you promptly to engage an immigration attorney to advise you about whether and how you should withdraw the pending petition. Note also that if the petition already has been approved, you may be stuck with the obligations specified in the Affidavit of Support. Some immigration law firms, including mine, offer legal services on a "flat fee" basis so that a client will know the total expense from the very beginning, and a few immigration law firms, including mine, offer an initial consultation free of charge.
