Once the sibling visa petition is approved, which may take a few years, the approved visa petition is transferred to the National Visa Petition, where it will remain until the Visa priority date is current. This can take ten, even over twenty years for some nations like the Philippines. The fourth preference visa petition category has fewer visas issued on an annual basis. This can create quite a bit of frustration among family members who think that it will take a matter of months, or perhaps five years, to immigrate. You can apply for a visitor visa at the US consulate, or you can wait until your daughter turns 21 to petition for you. If your daughter petitions for you, you will also be required to apply for a I-212 and I-601 waiver to reenter the US if you were unlawfully present for more than 1 year when you were deported in 2002.
