Hello, A good rule of thumb is to file for the dependent's visa along with the principal applicant's visa renewal if you, the F-1 visa holder have been out of status and have been instructed to file for a new visa. If your marriage was a fake, you have no relief. If your marriage was not a fake and your husband lied about it because he just changed his mind, well, you may still be unable to adjust status, unless there is some good valid reason why you are no longer married. Even if the marriage was not a fake, but he later just decided that this marriage does not work for him for any reason, you may be unable to adjust status. The only exception is if you can show that your husband was somehow abusive to you.
