When is the time to get a US citizenship?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
The process by which a foreign national who entered the U.S. lawfully and with inspection and who is married to a U.S. citizen may become a U.S. citizen involves these steps with this timeframe: 1) The couple must apply for "adjustment of status" by which the foreign national may become a Lawful Permanent Resident (get a "Green Card") 2) Generally, commencing 90 days before the end of three years of the date the foreign national became a Permanent Resident, the foreign national may file a petition for naturalization. 3) The USCIS is inconsistent in the amount of time it takes to adjudicate a naturalization petition, but generally a properly completed and fully documented case processed through the USCIS's Atlanta Field Office (covering all of Georgia and Alabama) takes about four months. Please note that the naturalization process includes, among other things, a test of a petitioner's skills with the English language, and it may be worthwhile for you to consider taking English as a Second Language instruction. Some immigration law firms, including mine, offer legal services on a "flat fee" basis so that a client will know the total expense from the very beginning, and a few immigration law firms, including mine, offer an initial consultation free of charge. Can I file another H1b while my Perm is in process?

Matthew Scott Kriezelman
Answered by attorney Matthew Scott Kriezelman (Unclaimed Profile)
Immigration lawyer at Kriezelman Burton & Associates, LLC
Yes you can. Although an H1B is a non immigrant visa, you are allowed to have dual intent. This means that you can enter on the H1B while still seeking to eventually become a lawful permanent resident of the United States.
