How do I go about marrying an Australian woman with the visa waiver program and temporarily staying in the U.S.?

Answered by attorney Jason Karavias

As a US citizen, if you marry, you can apply for your wife's green card right away and she will be permitted to remain legally in the US while her case is processed.

What visa can I apply for him to be an immigrant here in the US too and what is the easiest way for me to get him?

You should file form I-130 for your husband, but because you are not a citizen, there may be a long wait before this form is approved for him. Unfortunately, his son cannot help; in other words, it does not matter that he has a son who is a citizen. What matters is that you are not a citizen, so the wait is longer. If you become a citizen while this I-130 is pending, you can notify USCIS of this change, and your husband's case will go faster.

Can my boyfriend fix his papers in the US if he enters the country using a different name?

Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated, such as when and why he was deported to begin with and whether he is subject to a 10-year ban. I strongly suggest that you contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your boyfriend situation. He/she would then be in a better position to analyze his case and advise you and your boyfriend of his options.
