Can I sponsor my mother for immigration even if I don't have a job now?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
A U.S. citizen may petition for her mother even if the U.S.citizen is unemployed. If the U.S. citizen does not have sufficient documentable income, documentation about assets may be used (as specified on the instructions to the Form I-864 Affidavit of Support) or a joint sponsor may be used in the application process. Some immigration law firms, including mine, offer legal services on a "flat fee" basis so that a client will know the total expense from the very beginning, and a few immigration law firms, including mine, offer an initial consultation free of charge.

Can I petition my mom and how long would it take if I’m a 20 year old US citizen?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
A U.S. citizen age 21 or older generally is able to sponsor a parent for immigration benefits with an application in the Immediate Relative visa category. Of course, there are many other details that impact eligibility. It would be wise for you and your mother to consult with an immigration attorney about eligibilities, options and strategies, and if applicable, steps that might be taken to become prepared for filing an application the moment you become 21 years old.

Can I still help my spouse with his papers if I did my time 15 years ago?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
Generally a U.S. citizen's criminal conviction record from many years ago will have no impact upon eligibility to sponsor a spouse for immigration benefits. Of course, there are many details that determine eligibility for a marriage-based adjustment of status case. It would be wise for you and your spouse to consult with an immigration attorney who, after learning all of the relevant information, could advise about eligibilities, options and strategies to attain your goals, and who then could offer legal representation in the often complex application process.
