How can I get a work visa and work permit on my own if I already have a job letter confirming employment was granted?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
Having a job offer is not, by itself, a basis for obtaining immigration benefits, and there is no such thing as a "work visa." There are many different types of visas that are employment-related, however, and each has its own set of factors for eligibility. With very few exceptions, however, each employment-based immigration application requires a qualified sponsoring employer. An exception includes a self-petitioning application for certain people of "exceptional ability" who have advanced academic degrees, but you have not mentioned any detail that makes it sound like that would apply to you.

What can be done if I'm on F1 OPT and it expires in June 2017?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
A full analysis of eligibilities, options and strategies for you would require more information, including information about your husband's approved I-140 application, its visa category, your and his nationality, etc. There really is no substitute for consulting with an immigration attorney who, after learning all of the relevant information, would be able to advise you and would be able to offer legal representation in pursuing the most appropriate course of action.

Usually 30 to 90 days depending on why there was a delay in the decision. You can make an appointment through Infopass and inquire as to the status of the petition.
