You can apply to adjust status based on your marriage to the US citizen right now. I would suggest you meet with an attorney who can help you in filing a one step adjustment of status application. Even if ICE puts you in removal proceeding. before you have a chance to file the petition, you will still be able to adjust status in removal proceedings by proving you are in a bonafide marriage with a US citizen.

When a U.S. citizen has insufficient documentable income to meet the Affidavit of Support requirements, it is possible to have a "Joint Sponsor" participate in the marriage-based adjustment of status process. A Joint Sponsor need not be another family member, but instead generally can be any adult U.S. citizen or Permanent Resident with sufficient documentable income and who is willing to assume the responsibilities specified in the Affidavit of Support document. Some immigration law firms, including mine, offer legal services on a "flat fee" basis so that a client will know the total expense from the very beginning, and a few immigration law firms, including mine, offer an initial consultation free of charge.
