Depending on where your DUI took place, how many DUIs you have (I am assuming that you had two) and the date of your last conviction, the answer is usually yes. However, before you apply, you must be off of probation and not have any criminal convictions for at least 5 years preceding the date of application. I strongly suggest that you contact an experienced criminal law attorney for a face-to-face consultation and give him/her all of the facts surrounding your case. He/she would then be in a better position to analyze you case and advise you of your options.

You need to meet with an immigration attorney in person to see whether you can prevent the deportation. As a US citizen, you can petition for him, but the issue will be whether he is eligible to adjust his status in proceedings. Also, you should not wait to consult with an attorney in consideration of your husband signing an "exit form."

You would need to travel there or he would have to travel here so you can meet in person, then you can either get married there (or here if he can travel here), or you can bring him here on a fiance visa to get married to you here (but you have to have met in person first).
