Hello. Good question. When filing for naturalization, it is very important to review all of the facts and circumstances of each particular case. No two cases are exactly the same. Tax returns are helpful to prove certain elements in a naturalization case. If you did not need to file, you must prove those elements in other ways. The naturalization instructions recognize this fact in stating that tax returns are not required in every case. These issues must be addressed properly in your application. You are highly encouraged to consult with an experienced immigration lawyer prior to filing. Good luck!

Assuming 1) you are ready to and get married; 2) there is only one deportation; 3) no illegal entry after the deportation; and deportation was not for a serious crime THEN as the spouse of a U.S. citizen he would benefit from your petition. He will need a waiver in addition to the normal paperwork for an immigrant visa. To make sure of all the facts I would recommend you schedule a paid consultation with the three of us to review the facts and make sure of the steps to be followed, procedures, timing, fees, etc. This can be scheduled by contacting my office below.

Unless you are eligible under 245(i) law or perhaps a U visa. Otherwise you would need to apply for the GC at your US consulate in your home country. When you leave the US, this will trigger a ten year bar to re-entering so that gets very tricky. Make an appointment with a competent immigration attorney in your area to fully go over every detail of your case.
