You do have rights if you are abused; I would suggest a consultation to review the specifics of your case and discuss your options. You do not need to remain in an abusive situation. If necessary you can self-petition to remove conditions on the 2 year card but there are specific requirements. We do charge for consultations but these fees will be credited toward the fees for your case if you decide to retain us thereafter.

If your husband is being abusive to you there are ways that you can get help with immigration if you want to remain in the US. An international divorce can be very expensive so it will be fastest if you remain in the US if at all possible. Contact my office for a consultation if you wish additional information related to your case specifically on procedures and fees. It is largely in the discretion of immigration inspectors at the port of entry to determine whether to challenge your right to return based upon your period of absence in the past. That being said, the longer the period of time before going back outside the United States, the better. Ideally you would not go out for 6 months, but that is a choice for you to make.
