Yes if your boyfriend exits the USA he then will become subject to either a 3 or 10 year bar depending upon how much unlawful presence he has accumulated. To get around that he would have to file a waiver and proof of extreme hardship would need to be shown. Your best and safest bet is to relocate to the USA and process his paperwork here. My advice is to retain counsel to pursue the safest strategy for success. Every case is unique and every case must be delicately handled to assure the best chance of success.

It is possible for your husband to remain in the United States and apply for adjustment of status through 245(i); however, it will depend on the circumstances of his prior marriage and his immigration history. If his ex-wife's I-130 petition was not fully adjudicated, to remain eligible for 245(i), he must submit sufficient evidence to establish that the prior petition was approvable when it was filed with USCIS. The evidence can include, but is not limited to, proof of cohabitation, joint bank statements, joint health insurance, joint lease agreements, joint tax returns, photos, affidavits, birth certificates of any children born from the relationship, etc.

If you are a US citizen, you can petition for your parents to immigrate to the US as permanent residents on form I-130. You will need to submit a separate petition for each parent. It will take approximately 1 year to process the paperwork before they will receive an appointment to be interviewed on their visa applications at the US consulate.
