Can my friend return to the U.S. after voluntary deportation?

Answered by attorney David H Stoller (Unclaimed Profile)
Immigration lawyer at Stoller & Moreno, P.A.
The answer is probably yes. But keep a few things in mind. First, getting back to the US generally requires a visa. Qualifying for a visa may be as difficult to do in this situation as ithe issue of your friend having remained here without authorization. Second, your friend's arrest may likewise create a problem obtaining visa issuance. Third, a common misconception is that someone who leaves the US after having been granted voluntary departure can immediately turn around and apply to return as if no violation of that individual's immigration status has occurred. Not true. Yes, leavind under an order of voluntary departure may avoid SOME problems trying to return, the fact is that anyone who leaves after having remained here in violation of US immigration law is unlikely return without a fight. My advice would be to consult with a competent attorney and become informed. Be careful out there. Good luck.

How soon can I come back from my country to apply for adjustment of status and stay with my wife?

Justin Wang
Answered by attorney Justin Wang (Unclaimed Profile)
Immigration lawyer at Sheppard Mullin
I assume you have a B visa. you can certainly visit the US again using B visa provided the purpose of your visit is consistent with your visa. The fact that you married a US citizen cannot in itself prevent you from visiting the US. Practically, US Immigration should not know you married a US citizen.

Can we pay a fee instead of being forced out of the country?

Answered by attorney Carlos E. Sandoval
Immigration lawyer at Carlos E. Sandoval, P.A.
It depends how he entered the United States, and whether he was the beneficiary of a petition before. We would need to know more information with respect to your case.
