Can I petition to have my wife and 2 step children come to the US?

Answered by attorney Louis M. Piscopo
Immigration lawyer at Law Offices of Louis M. Piscopo, APLC
As a Green Card holder you can petition your wife and step-children. It will take approximately 2-5 years for their priority date to become current, depending on what country they were born in. There is no waiver or process to speed it up, other than you becoming a U.S. Citizen as soon as you are eligible to do so. Also, I assume that you were not married at the time you got your Green Card because if you were your wife and step-children would have been derivative beneficiaries and could have been eligible for a Green Card at the same time you were.

I-130 form

Answered by attorney Doreen A. Emenike
Immigration lawyer at Law Offices of Doreen A Emenike
Hello,   From the information you have provided, you might not be able to speed up the processing time for your green card even if your  mother filed an I-130 for you. You would still be in the "unmarried son of a U.S. citizen over 21 years old" category which puts you on a waiting list with the USCIS. You will be on this waiting list until the USCIS is processing applications received as of December 17, 2012 or later. At that time you will be able to file the rest of your green card application. You may want to take your I-130 approval notice and consult with a local attorney with details about your situation. Good luck.   Disclaimer:  The answers to frequently asked questions are based on limited information available to us.    The answer provided is of a general nature  and does not establish an attorney - client relationship.  It is not, nor is it intended to be, legal advice. You should consult an attorney for specific advice regarding your individual situation.

What is the best option for marrying my girlfriend on a tourist visa?

Answered by attorney Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)
Immigration lawyer at Havens Lichtenberg PLLC
If the goal is to be apart as little as possible, then getting married and applying for a green card is the best option. Immigration will give you hard time if the marriage occurs within 3 months from the date of entry on a tourist visa; the longer you wait, the less questions will be asked about your girlfriend's intent at the time she entered the U.S. Leaving the marriage until almost the end of her 6-month authorized stay will also give you more time to make sure you two belong together.
