I am on ssdi and me and my Philippine girlfriend would like to get married and move her and her son to the united states

Answered by attorney Stephen Arnold Black
Immigration lawyer at The Law Office of Stephen A. Black
Hi Jason.. Yes it can happen. First, have you physically met your girlfriend within the last two years? Second, are you a US citizen? Third, since you are on SS disability, you may need a joint sponsor who can submit his/her tax returns to show USCIS that his income meets the minimum threshold. The minimum amount needs to be at least 125 percent of the poverty level based on your household size. So add up all the people who live in your household now plus your girlfriend and the children she will accompany her to the US, and multiply by 1.25. If all the aforementioned factors can be met, you can sponsor her for a fiancé K visa which takes a little less than a year and then she can adjust status to get her green card after she travels to Texas and gets married to you. Consider working with an attorney. Some of us, including myself, charge a very affordable flat fee for the entire case process. I enter an appearance of attorney of record in the case by filing the G28 form.  Counsel in any state can represent you both.

Would it be a problem for my citizenship if I didn’t provide a selective number which I was not aware of?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
Generally, failure to register for Selective Service because an applicant was unaware of the requirement will not stand in the way of eligibility for naturalization. Information about Selective Service registration must be answered accurately on the naturalization petition; a letter from the Selective Service showing that you now are too old to register should be supplied to the USCIS; and you should be prepared to explain that the failure to comply with your legal obligation to register was due to not knowing of the requirement rather than due to a willing refusal to comply with the law or due to a lack of good moral character. These are just some of the details of importance in the naturalization application process; it would be wise for you to work with an immigration attorney to assure eligibility and to assure proper completion and supply of full supporting documentation in the application process.

Is there any rish that I will lose my visa when I enter the US?

I doubt you'll have any trouble at the border, as long as you didn't lie to get the WIC. As far as an H1B, you'd need to meet the educational and/or work experience requirements, and have an employer who wants to sponsor you for a job that needs your educational background.
