After divorce can I still get my permant green card?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Individuals who can show that they have had a bona fide marriage are able to remove the conditional basis of their green cards by themselves. In your case, having a baby and house together would be sufficient to prove a bona fide marriage. You can file the form I-751 at any time after you obtain a divorce.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. Could I get in trouble with the USCIS because of the domestic battery charge if I have a permanent resident card with no condition?

Whether charges will be dropped or not, will be up to the D.A. and jail time is always a possibility. Another problem arising from a domestic battery charge is the possibility that you may be arrested by ICE and place in removal/deportation proceedings. I strongly suggest that you contact an experienced immigration and criminal defense attorney for a face-to-face consultation and give him/her all of the facts surrounding your case. (S)he would then be in a better position to analyze your case and advise you of your options. You should not use the services of the Public Defender's Office, since it has been my experience that very few Public Defenders are aware of the immigration consequences of criminal charges.

When will I receive my call for an interview if my F$ visa has been approved in 2010?

Fakhrudeen Hussain
Answered by attorney Fakhrudeen Hussain (Unclaimed Profile)
Immigration lawyer at Law Offices of Hussain Gutierrez
Right now the visa in your category is current for people who applied before May 2001. If your priority date is 04/2005, at minimum it will take another 4 years.
